Xoba, Inc., a Delaware corporation d/b/a Xoba (“Xoba”, “Xoba Labs”, “Company”, “us” or “we”), we respect and protect the privacy of visitors to our website, www.xobalabs.com and the other websites under the xobalabs.com domain (collectively, the “Sites”), and our customers who use our application (the “App”) and services integration platform, tools, and related services (together with the Sites, the “Service”). This Privacy Policy (“Policy”) explains how we collect, use, disclose and protect visitors’ and customers’ (“Users”) information as part of the Service. Any discussion of your use of the Service in this Policy is meant to include your visits and other interactions with the Sites and Services, whether or not you are a user of Xoba’s platform.

This privacy policy governs your use of the software application Xoba (“Application”) that was created by Xoba, Inc. The purpose of this privacy policy (“Privacy Policy”) is to inform you what personally identifiable information or personal information we may collect from you when you use our application or visit this website, how we use such information, and the choices you have regarding our use of, and your ability to review and correct, the information.
Information gathering and usage
When registering for Xoba, we ask for information such as your name, email address, and password. The Application may collect certain information automatically, including, but not limited to, the type of device you use, your web browser, your device’s unique device ID, the IP address of your device, your operating system, and information about the way you use the Application. We also collect aggregate data regarding the webpages that visitors access on the website. The information we collect is used to improve Xoba and the quality of our service and is not shared with or sold to others.

The Company may share aggregated, non-personally identifiable information publicly and with our partners – like publishers, advertisers or connected sites. For example, we may share information publicly to show trends about the general use of the Application and website.

We may provide your personal information to companies that provide services to help us with our business activities such as offering customer service. These companies are authorized to use your personal information only as necessary to provide these services to us. In all other instances, we may share your personal information with our partners and clients with your consent.

If we are involved in a merger, acquisition or asset sale, we will continue to ensure the confidentiality of any personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy.

We will share personal information with companies, organizations or individuals outside of Xoba. if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:
meet any applicable law, regulation, legal process or enforceable governmental request.
enforce applicable Terms of Service, including investigation of potential violations.
detect, prevent, or otherwise address fraud, security or technical issues.
protect against harm to the rights, property or safety of Xoba, our users or the public as required or permitted by law.

Accounts
Account Creation. In order to use certain features of the Site, you must register for an account (“Account”) and provide certain information about yourself as prompted by the account registration form. You represent and warrant that: (a) all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information. You may delete your Account at any time, for any reason, by following the instructions on the Site. Company may suspend or terminate your Account in accordance with Section 8.
Account Responsibilities. You are responsible for maintaining the confidentiality of your Account login information and are fully responsible for all activities that occur under your Account. You agree to immediately notify Company of any unauthorized use, or suspected unauthorized use of your Account or any other breach of security. The company cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

Information we collect
We collect information to provide better services to all Users of the Service.
We collect information in two ways:

Information you give us. In connection with your use of certain features of the Service, we may ask for personal information, like your name, email address, telephone number or credit card.
Information we get from your use of the Service. We collect information about the features on the Application that you use and how you use them. This information includes, but not limited to:
Device Information. We collect device-specific information (such as your hardware model, operating system version, unique device identifiers and mobile network information including phone number).
Log information. When you use our Application, we automatically collect and store certain information in server logs.
This includes:
details of how you used our Application, such as your search queries.
Internet protocol address.
device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL.
cookies that may uniquely identify your browser or your account.
Cookies and anonymous identifiers. We and our partners use various technologies to collect and store information when you use our Application, and this may include sending one or more cookies or anonymous identifiers to your device.

Your data
Xoba uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the application and website. Although Xoba owns the code, databases, and all rights to the Xoba application and website, you retain all rights to your data. Xoba will safeguard your data and information as our own and will not share your personal data or information with any unauthorized 3rd party vendors without your consent.

Xoba will retain Personal Information we process on behalf of our customers or collect directly from our customers for as long as needed to provide Service to our customers, subject to our compliance with this Policy. We may further retain and use this Personal Information as necessary to comply with our legal obligations, maintain accurate accounting, financial and other operational records, resolve disputes, and enforce our agreements. We have established internal policies for the deletion of data from customer accounts following the termination of a customer’s subscription to the Service.

Additional Limits on Use of Your Google User Data
Notwithstanding anything else in this Privacy Policy, if you provide Xoba access to the following types of your Google data, Xoba's use of that data will be subject to these additional restrictions:

Xoba will only use, access, read, or control Gmail message bodies (including attachments), metadata, headers, and settings to provide a web and mobile application that allows users to search and access this information. Xoba will not transfer Gmail data to others unless doing so is necessary to provide and improve these features, comply with applicable law, or as part of a merger, acquisition, or sale of assets.

Xoba will only use, access, read, or control Google Drive folders, documents, spreadsheets, presentations, metadata, headers, and settings to provide a web and mobile application that allows users to search and access this information. Xoba will not transfer Google Drive data to others unless doing so is necessary to provide and improve these features, comply with applicable law, or as part of a merger, acquisition, or sale of assets.
Xoba will not use this Gmail or Google Drive data for serving advertisements.

Xoba will not allow humans to read this data unless we have your affirmative agreement for specific messages, doing so is necessary for security purposes such as investigating abuse, to comply with applicable law, or for Xoba's internal operations and even then only when the data have been aggregated and anonymized.

Data Retention
Xoba will retain Personal Information we process on behalf of our customers or collect
directly from our customers for as long as needed to provide Service to our customers, subject
to our compliance with this Policy. We may further retain and use this Personal Information as
necessary to comply with our legal obligations, maintain accurate accounting, financial and
other operational records, resolve disputes, and enforce our agreements. We have established
internal policies for the deletion of data from customer accounts following termination of a
customer’s subscription to the Service.

Cookies
We use cookies to store visitor preferences, customize webpage content based on visitor browser type or other information that the visitor sends. Cookies are required to use Xoba.

Ad servers
We do not partner with or have special relationships with any ad server companies.

Security
All data and information transmitted with Service is secured by SSL protocol. We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Opt-out rights
You can stop all collection of information by the Application easily by deleting your account in the Application. You can also request to opt-out via email, at support@xobalabs.com.

Your California Privacy Rights
Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to ask us for a notice identifying the categories of Personal Information which we share with our affiliates and/or third parties for marketing purposes, and providing contact information for such affiliates and/or third parties. If you are a California resident and would like a copy of this notice, please submit a written request to privacy@xobalabs.com.

Children
We do not use the Application to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at support@xobalabs.com. We will delete such information from our files within a reasonable time.

Changes
If our information practices change at some time in the future, we will post the policy changes to our website to notify you of these changes and we will use for these new purposes only data collected from the time of the policy change forward. If you are concerned about how your information is used, you should check back at our website periodically. Your continued use of the Service constitutes your agreement to be bound by such changes to this Policy. Your only remedy, if you do not accept the terms of this Policy, is to discontinue use of the Service.

Consent
By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. "Processing,” means using cookies on a computer and or mobile device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the United States your information will be transferred, processed and stored there under United States privacy standards.
